All deliveries and services within the scope of the Internet offering on lilyskitchen.com/de are provided by Lily’s Kitchen Europe GmbH (hereinafter referred to as Lily’s Kitchen Europe). Lily’s Kitchen Europe is the seller and supplier of the products purchased through this webshop. All deliveries and services are subject to the following provisions. Lily’s Kitchen Europe does not recognize any deviating customer conditions.

  1. Conclusion of Contract

The purchase agreement is concluded with Lily’s Kitchen Europe.

The presentation of the products in our online shop does not represent a legally binding offer, but rather a non-binding online catalog. By placing an order, the customer makes a binding offer to purchase the desired goods to Lily's Kitchen Europe.

We will immediately confirm receipt of the order to the customer via an automated email.

For the payment method “PayPal”, the offer is accepted by sending the confirmation of receipt. The purchase contract is concluded upon receipt of this confirmation of receipt.

If you do not receive confirmation of receipt within two days of placing your order, the order is deemed not to have been accepted.

The order is placed at the prices and information stated on the day of the order.

Lily’s Kitchen Europe reserves the right to cancel orders that have resulted from manipulative, abusive behavior.

  1. Changes to the Terms & Conditions

Lily’s Kitchen Europe further reserves the right to change these terms and conditions, in particular the delivery and payment conditions, with effect for the future if legal provisions require this or if this is necessary to improve processing or prevent misuse. The general terms and conditions in force at the time of your order apply to your order.

  1. Cancellation Policy for Consumers

You have the right to cancel this contract within fourteen days without giving any reasons.

The cancellation period is fourteen days from the day on which you or a third party designated by you other than the carrier receives the goods (or in the case of a contract for several goods that you have ordered as part of a single order and which are delivered separately , the last goods that you or a third party named by you who is not the carrier) took or has taken possession of.

inform you of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email).

You can use the attached sample cancellation form, although this is not mandatory.

In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.

  1. Consequences of Revocation

If you cancel this contract, we will refund to you all payments received from you, including delivery costs (except for additional costs resulting from you choosing a method of delivery other than the cheapest standard delivery offered by us have) to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier.

  1. Returns

If goods that can be sent by parcel are returned, the customer must pack the goods in a way that protects them against typical transport risks. If possible, the original product packaging should be used when returning.

We bear the costs of returning the goods. To make returns easier, we have included a return label with the delivery. The use of the sticker is voluntary.

 

  1. Payment Terms

The customer can pay via PayPal or credit card.

If a customer pays for purchased items via PayPal, PayPal's general terms and conditions apply 
paypal.com/de/legalhub/useragreement-full. If the payment method is PayPal, the customer will automatically be redirected to PayPal's secure payment form after submitting their order. If they already have a PayPal account, simply log in. Otherwise, the customer clicks “Set up account” and follows the instructions.

The debtor of a payment claim will be in default at the latest if he does not pay within 30 days of the due date and receipt of an invoice or equivalent payment statement.

Costs of €5.00 will be charged for each reminder issued after the default has occurred. If a debit order is not processed or is reversed as a result of an objection, Lily’s Kitchen Europe is also entitled to charge a flat rate of €2.50 as well as the bank fees incurred. In any case, the customer is expressly permitted to prove that no damage or reduction in value occurred at all or that it was significantly lower than the flat rate.

Lily’s Kitchen Europe reserves the right not to offer certain payment methods in individual cases.

 

8. Taste Promise

For products that you have purchased in our own Nestlé Lily’s Kitchen Europe online shop, we make the taste promise described below:

  • If your pet unexpectedly refuses to eat our food, you have the option to return the product and get your money back. To do this, please proceed as follows:
  • Call customer service and state that you want to take advantage of the taste promise.
  • A return label and a form will then be sent to you by email on which you can enter your bank details in the SEPA area.
  • Now send the remaining food (at least 75% of the original filling quantity) with the original invoice and the form with the bank details to the following address:

The purchase price of a maximum of €100 will then be refunded to you. There will be no refund of any shipping costs paid. A refund can only be claimed once for each product per member account.

 

  1. Retention of Title

The goods remain the property of Lily’s Kitchen Europe until full payment has been made.

  1. Final Provisions

The contract text will not be saved by Lily’s Kitchen Europe after the contract has been concluded and will not be accessible to the customer.
